Jan Ullrich successfully resists the accusations, which are raised in connection
with the Spanish physician Dr. Fuentes against him.

The biking star (and attorneys) obtained a provisional gag order from the
Hamburg regional court against Professor Dr. Werner Franke. The molecular
biologist may not say that Ullrich spent 35,000 euro in one year alone for the
acquisition of illegal substances. If the Heibelberg doctor violates this gag
order, he faces up to 250.000 euro fine or 6 months detention.

Sports lawyer Michael Lehner has insisted former Tour de France winner Jan
Ullrich's chances of escaping from the 'Operacion Puerto' doping scandal without
a suspension, could rise due to the lack of a test proving his guilt.

"Due to the fact that there is neither a positive A nor B sample, the case
against him will be complicated" said Lehner, who has already represented
cyclist Danilo Hondo and 1500m runner Dieter Baumann in their fights against
doping allegations.

32 year-old Ullrich was sacked from his T-Mobile team for failing to prove his
innocence after being named as one of 58 cyclists implicated in a blood doping
ring orchestrated by disgraced Spanish doctor Eufemiano Fuentes.

As he is now resident in Switzerland, Ullrich will stand trial before the Swiss
Cycling Federation, though the federation boss Roland Schläfli confirmed that as
yet, they had received no documentation from the International Cycling Union.

He told German press agency dpa: "When we have the papers from the international
union, the process is very quick. We will need around a week to decide whether
to pass the case to the disciplinary commission, who can then open a case.

"If it came to that, a judgement could be passed after one further week. As far
as I know, it would be the first time a case would be brought forward without a
positive test result" he added.

UCI spokesman Enrico Carpani insisted the documents would arrive soon, saying
"It can only be a matter of days until the files reach the Swiss Federation. The
Italians already have theirs."

Should the UCI - or indeed the rider - regard the decision of the national
federation as unjust, then further action could be taken, explained Carpani.

"If we're not happy with the decision of the country's federation, then we can
call in the international Court for Arbitration in Sport."

Should Ullrich be found guilty, a mandatory two year ban is likely. Crucially
though, a further two year-ban from riding with any Pro-Tour teams could also be
applied, ruling the rider out of cycling's three big stage races - the Tour de
France, Vuelta a Espana and Giro d'Italia - until 2010.

Looks like Landis rode "the ride of the century" as the news blabographers
called it, while cheating.  Phonak officials were NOT available for comment. 
What a surprise (NOT) - how ELSE could he ride with a hip which is so bad he can
hardly walk at times?   And by the way, Lance was NOT exonerated as the article
claims - he simply paid off the group and "got out of Dodge" - he was also
connected with the same doc which got Ullrich and Basso fired.....

Some people are bound to be shocked to learn that the winner of the Tour de
France has tested positive for performance-enhancing drugs. These are the same
people who would be shocked to learn that beer is consumed at fraternity
parties, that four-year-olds like chocolate and that professional wrestling
matches are fixed.

Yes, it's tough that the guy caught is an American, Floyd Landis, but it can't
be a surprise. One of the reasons Landis won is because the pedal-pushers who
finished second, third and fourth last year were banned for drugs before the
race even began. Every time you turn around, it seems as if there's another
story about a rider doing drugs.

Why should we be surprised that the drug cops made another bust?

Cycling and drugs go together like Valentine's Day and roses. There's a good
reason for it: it is perhaps the most grueling and physically demanding sport
there is. The Tour de France is a three-week race covering a couple of thousand
miles with just two days off.

Take the best athlete from any other sport, put him on a bicycle, and have him
ride just one stage of the tour. He'd barely be able to walk the next day and
wouldn't want to ride a bike again for quite some time.

Now do it every day for a week, and throw in gut-busting climbs up impossible
grades in the Alps and blistering time trials in which the riders go as fast as
they can for dozens of miles.

If ever there were a sport made for drugs, cycling is it. So it's no surprise
that the sport has been saturated with them for as long as anyone can remember.
If a doctor or chemist can find something that will help the riders go longer
and faster, something that will allow them to keep pumping through the screaming
pain, there will be a market - a big one - for it.

You name it, riders have used it, from brandy and laudanum in the ancient days
to amphetamines later on, to human growth hormone to steroids, to EPO, a drug
that allows the blood to carry more oxygen. Riders also reinfuse themselves with
their own blood, increasing the volume of blood and thus the volume of oxygen it
can carry, a practice called blood packing.


In a way, it's been an even playing field, because just about everybody was
doing it. So no one was getting an advantage that others didn't have.
Unfortunately, all the drugs also led to dozens of deaths, and no sport likes to
have its participants dying off in the middle of competitions. It doesn't look
good.

And when the public catches on, it gets offended. Of all the charades we buy
into in life, one of the most enduring is the myth of clean competition. We will
pay large amounts of money to watch people with bodies not found in nature do
things that we'd always considered to be impossible. Then, if they don't test
positive for anything, we allow ourselves to believe that they did it honestly.

It's a lie we gladly tell ourselves because it allows us to continue to enjoy
something we love. It's like someone who has mountains of evidence to suggest
that a spouse is cheating and chooses to ignore it because, well, because life
works better that way.

Still, even the craftiest cheater can get caught, and that's when the problems
start. It was pretty well known for years that cyclists cheated any way they
could. But the real efforts to clean up the sport began in 1998, when seven
teams were kicked out of the Tour de France, the granpere of all races, for drug
use.


The campaign was successful only in that it inspired the athletes to find better
ways to cheat the drug tests. The following year, Marco Pantani, the previous
year's winner, was thrown out for doping. In 2004, more than a dozen riders were
expelled. After last year's record seventh straight win by Lance Armstrong, the
French sports newspaper, L'Equipe, reported that tests performed on one of
Armstrong's preserved urine samples from 1999 revealed evidence of EPO, a
popular drug in cycling that boosts the blood's capacity to carry oxygen. An
investigation launched by the International Cycling Union exonerated Armstrong,
but it didn't stop people from saying he cheated.

This year, there were the series of suspensions before the race began. Clearly,
all the testing and all the enforcement efforts have done nothing to stop the
cheating; they've only forced the cheaters, who probably include most if not all
of the top riders, to find better ways to hide the evidence.

The surprise here is that Landis got caught so late in the race. The offending
sample was taken after the 17th stage, the same one in which he put on an
unbelievable performance a day after all but falling out of contention. People
marveled at his ability to recover. Now, there is evidence that he had help in
the recovery.

There will be appeals and tests of back-up samples. But it looks as if Landis,
desperate to win, took a chance after his terrible performance in stage 16. He
wanted to win and knew he had to do something extraordinary to do it. So he did
some drugs he hoped wouldn't be detected.

That's just a theory, but it makes sense. He lost the gamble, which will make a
lot of people in France and Europe very happy because finally, a Yank got caught
doing what everybody else has been doing.

But it won't change the underlying truth of big-time cycling: It's a cheater's
sport.

Jan Ullrich is looking for a new team so he can end his career with a Tour de
France victory next year.

The German rider, who was barred from the Tour de France and fired by his
T-Mobile team in a doping scandal, told the Swiss daily Blick on Tuesday that he
was in contact with Lance Armstrong's Discovery Channel team but that no
concrete agreement had been reached.

"I have always said, 'I will finish with a Tour victory,"' Ullrich said.
"Unfortunately, this year I was prevented from doing so. That's why I will try
to add another year."

Ullrich, who won the 1997 Tour and was runner-up five times behind the
seven-time winner Armstrong, was considered a leading contender for this year's
Tour. He was forced out on the eve of the race because of his links to a Spanish
doping investigation.

Ullrich was fired by T-Mobile, which said he had failed to prove his innocence.

Ullrich's name turned up on a list of 56 cyclists who allegedly had contact with
Spanish doctor Eufemiano Fuentes. Cyclists allegedly went to his Madrid clinic
to have blood extracted for doping or to collect performance-enhancing drugs.
Ullrich has denied wrongdoing.

Ullrich met in Bonn on Tuesday with T-Mobile management who sacked him last
week.

The German has been implicated in a Spanish doping investigation and was
withdrawn ahead of this year's Tour which ended on Sunday. He has consistently
protested innocence.

T-Mobile team spokesman Christian Frommert said on Tuesday: "There were talks in
Bonn, the lawyers met. It was a very good and constructive meeting.

"We agreed to not comment on the content. We fixed the date for the next
meeting. There is no agreement yet but it was constructive and there will be
more meetings."

He added: "(Jan's ability to sign with another team) depends on the outcome of
these meetings. He was dismissed, now it is a question of what comes out of
these meetings.

"Once it is cleared up then of course other teams can make him an offer but the
question is whether from a sports law point of view he can ride. That is outside
of our remit."

Earlier, in an interview with Swiss tabloid newspaper Blick, the German rider
maintained his innocence and said he refused to accept his sacking.

"I do not accept the termination of my contract because in my opinion there is
no reason for it," Ullrich said. "I expected more support from the team.

"I have never cheated another rider in my whole career. That is a fact. This
year I have undergone 11 unannounced doping tests in training and countless
out-of-competition tests, all of which were negative."

Leipheimer joins Discovery Channel
Levi Leipheimer will leave Team Gerolsteiner at the end of the season and sign
for Discovery Channel, according to Gerolsteiner bike sponsor Specialized.

"My best results, wins at the Tour of Germany and Dauphiné Libéré, happened on
my S-Works Tarmac SL, but Discovery (Channel) made me an offer I could not
refuse," Leipheimer said.

The UCI said it won't disclose the rider's name, team or nationality pending
completion of the testing process. The initial positive finding must be
confirmed by analysis of the backup sample.

"The UCI received today a report of the anti-doping laboratory of Paris stating
an adverse analytical finding following an anti-doping test carried out at the
Tour de France 2006," the statement said.

The UCI said the rider, his team, the national federation and the national and
world anti-doping authorities had been informed.

The French lab that conducted the tests could not be reached for comment
Wednesday night.

Tour spokesman Mathieu Desplats expressed surprise at the result and said race
officials would await final results before taking any action. He would not
comment further.

The Tour de France finished Sunday, with American cyclist Floyd Landis winning
the three-week race after the final ride through central Paris.

On the eve of the Tour's start, nine riders - including pre-race favorites Jan
Ullrich and Ivan Basso - were ousted, implicated in a Spanish doping
investigation.

The names of Ullrich and Basso turned up on a list of 56 cyclists who allegedly
had contact with Spanish doctor Eufemiano Fuentes, the doctor at the center of
the Spanish doping probe.

Athletes allegedly went to Fuentes' Madrid clinic to have blood extracted for
doping or to collect performance-enhancing drugs. Nearly 100 bags of frozen
blood and equipment for treating blood were found at the clinic, along with
documents on doping procedures performed on cyclists.

Hello fan,

I am excited each day, along with my teammates from the T-mobile team. It is
madly like they took up the fight, although there are only 7 on the team in the
Tour. We stand by telephone and are constantly in contact. Thus I always
experience, how they are.

When Matze Kessler at the Cauberg sprinted to the victory, it kept me on the
edge of my seat. Somehow, he found again the courage to attack, although he had
been caught [in the breakaway] on the day before only 100 meters before the
finish line.

When Matze dedicated to me then before all eyes the stage win, I had tears in my
eyes.

The team continues to fight, therefore I ask also all my fans to continue to be
loyal to T-mobile and support it further. The members earned that support. They
give everything!

Many autograph requests and nearly 2000 emails reached Jan Ullrich after his
suspension from the Tour. The majority of fans are encouraging to Jan. They
cannot believe, what is accused of the biking star.

Still there is no information from Spain. Jan does not know thus yet, what he is
accused of. As long as no written details are present, the attorneys advise
against Jan talking to the press or taking any steps.

With a heavy heart, Jan follows what is advised.

Hello fans,

I am deeply shocked and cannot believe it yet. I am not allowed to start with
the route. It is a nightmare.

I do not have to do anything with the thing! I prepared in this year better than
ever. I am in excellent form and must watch now.

The exclusion of the route de France is the worst, which happened to me in my
career so far. I got and did not also receive nothing from official side, which
offenses I am accused of. All my Doping control [tests] so far and the test with
the route were negative.

I will need a few days peace and then with my lawyer will try to prove my
innocence. I do not give up!

I would like to ask you, cheer on my colleagues of the T-mobile team, that they
do their best with the tour de France.

Today's Prologue featured a phenomenal start to the 2006 Tour de
France. Thor Hushovd (CA), last year's Green Jersey Winner (Best
Sprinter), won by less than 1 second over George Hincapie (DIS)!
Other than Hincapie, a number of riders will undoubtedly be vying
for the Podium. Today there were strong showings from Alejandro
Valverde (CDE), Floyd Landis (PHO), Cadel Evans (DAV), and
Christophe Moreau (AG2R) to name just a few of the GC contenders.
As the Tour continues, some of the early GC contenders will probably
choose to battle Michael Rasmussen (RAB), who did not have a good
Prologue,and others for the King of the Mountains (KoM) title.
Also, this year's Green Jersey competition should be hotly contested
by Hushovd, Tom Boonen (QS), Stuart O'Grady (CSC), and Robbie McEwen
(DAV). Lastly, Discovery did well, as expected, in the Fastest Team
competition. However, CSC and T-Mobile did exceptionally well for
teams that are unfortunately missing their leaders - Ivan Basso and
Jan Ullrich, respectively. The Daily Stage Wins competition of
Pick the Podium! begins tomorrow, 7/2, with Stage 1.

How does everyone feel about Jan being disqualified for only suspicions, no
proof?  Isn't it interesting that those guys in the top 4 spots in last years
TDF were all disqualified this year? Some one wanted them out of the way.

This is against precident because usually there must be PROOF of doping before
disqualification and if there are only allegations (as are now), they are
allowed to compete and then, if proof comes later, stripped of their medals.

I am so disgusted, I am not planning to even watch the TdF....  I think this is
very unfair with Jan Ulhrich and Basso....

all at yesterday's ITT, he even didn't wear his timetrail suit. I
