South Palm Beach County & Trails Meeting
 
Please circle November 7th on your calendar - between the hours of 4:30 - 7:30 PM - for attending the next South Palm Beach County Greenways & Trails Meeting. The meeting will take place at the: Okeeheelee Nature Center, located at 7715 Forest Hill Blvd., in Lake Worth.
 
You can stop by any time between these hours and review, comment and participate on a proposed network for greenways, pathways, and blueways (water based corridors). Questions and comments should be directed to: Bret Baronak (561) 684-4163.

Tim Granowitz.  Since many of you may not know Tim, here's a brief bio. Tim is a registered landscape architect and the Principal Planner of the Palm Beach Parks and Recreation Department. Tim has been with the County for 28 years, and has planned and designed many of the County's parks - including Gulfstream Park and the West Boynton District Park. He has also designed and built the majority of the County's neighborhood parks. Tim also produced the site plan for the John Prince Boundless Playground - a nationally recognized playground.  Tim has been involved in the County's Comprehensive, Recreation and Open Space Planning since 1989. In summary, Tim is extremely qualified and knowledgeable. We are indeed fortunate to have a person of his caliber involved in this project.

Florida House Bill (HB) 1465 Report

 

As all long term SAFE Members know, SAFE  has consistently praised the professional and dedicated FDOT engineers. In fact, SAFE's only criticism of FDOT has been its decision not to build sidewalks and bike lanes on SR A1A where they are so desperately needed; the poor SR A1A drainage work in Highland Beach; and, in refusing to let the public know about the 3' passing law by erecting "Obey 3' passing law" road signs. "Share the Road" just isn't enough in today's world when you ask drivers and bicyclists to share the same space that's simply not wide enough for both (as is so clearly demonstrated by a "letter" at the end of this newsletter). 
 
Well, back to HB 1465.... SAFE is very pleased that in the 2006 Legislative Session, the House passed HB 1465 which was approved by the Senate, and subsequently signed into law by Governor Jeb Bush. That bill, among other provisions, directed the FDOT, the Florida Department of Highway Safety and Motor Vehicles, and the Florida Department of Education to undertake a study to evaluate highway safety and transportation issues related to overall public safety.
 
Well, the study has been completed. And, in SAFE's opinion - "You Can Get There From Here - Safely" is one of the best studies ever done by the FDOT. The goal set is very ambitious - to reduce Florida traffic fatalities by one-third in 5 years! SAFE applauds FDOT, the FDHSMV, and the FDOE for their recommendations. SAFE also is asking our Florida legislators to act as recommended by this report.
 
SAFE's 2008 State Law Initiatives
 
SAFE President Charlie Bonfield and I have been making the rounds of state legislator's offices asking legislators for their help in enacting some of the same recommendations called for by the report mentioned previously (and a few other initiatives, too).
 
Charlie and I have been pleased by the reception we have received from the legislators. They know us (not surprising, since they've been receiving a complementary copy of SAFE's Newsletter for several years): and, they are interested in listening to our proposals. Several legislators acknowledged the contribution SAFE has made in improving road safety. Visiting our state legislators has been a very rewarding experienced for Charlie and me. And, it's especially meaningful because the legislators found time from traveling back and forth to Tallahassee to even meet with us. In fact, all of the legislators we visited, met with us for over an hour.
 
Charlie and I will be formally presenting SAFE's recommendations at a Palm Beach Legislative Delegation Meeting next month.
 
Without further adieu, let me share those initiatives with you:

SAFE's Steps for Reducing the Number of

Motor Vehicle Crashes & Fatalities in Florida

November 13, 2007

  1. Co-sponsor and support legislation that prohibits driver use of hand-held cell phones & all hand-held electronic devices (including text messaging). Ref. House Bills (HB) 175 & 193 and Senate Bills (SB) 266 & 504.

SAFE’s Comment:  Already 47 other countries now ban cell phones when driving unless used with some form of hands-free kit. Countries include: Australia, Austria, Belgium, Brazil, Chile, China, Czech Republic, Denmark, Egypt, Finland, France, Germany, Greece, Hong Kong, India-New Delhi, Ireland, Israel, Italy, Japan (since 1999), Netherlands (up to 2,000 euros or two weeks in jail), Norway (fines of $600/infraction), Philippines, Poland (fines may be as high as $1,000), Portugal, Romania, Russia, Singapore, Slovak Republic, Slovenia, South Africa, South Korea, Spain, Sweden, Switzerland, Taiwan, Thailand, Turkey, and the UK.

In the US, only four states (CA, CT, NJ, and NY) and the DC now have such a ban. Could it be that powerful phone lobbyist stand in the way of Florida adopting a similar ban?

  1. Propose legislation that provides a dedicated revenue source (like the previously proposed $2/day car rental charge) in order to leverage additional federal transportation funding.

SAFE’s Comment: In the present tax cutting environment, only the state can implement the necessary dedicated revenue source needed to obtain additional federal transportation funds. Without state initiative, South Florida will continue missing out on obtaining the absolutely necessary funds to build a public transportation system. Without a viable public transportation system, South Florida roads simply will not handle forecasted traffic demands. As someone said a long time ago, “Detroit has proven that it can produce cars, faster then roads can be built”.

  1. Provide school bus service for any child who lives less than 2 miles from school if there are no sidewalks or a crossing street has a speed limit of greater than 35 MPH.

SAFE’s Comment: The 2 mile rule is archaic. The 2 mile rule was established in a time when it was safer for children to walk to school. Now, the increased number of motor vehicles and wider roads (some with as many as 9 – 11 lanes, and little or no median) make it unsafe for children to walk or ride a bicycle to school. In addition, a full bus of children, takes 30 or so cars off the queue of parents dropping off and picking up children.

  1. Allocate 4% of all federal and state transportation funds for the purpose of filling in sidewalk and bicycle lane gaps in urban areas (as identified by the Statewide Bicycle and Pedestrian Facilities Studies) until such time as all the gaps are filled in.

SAFE’s Comment: The recently released “Statewide Pedestrian Facilities Study” reported that on state roads, in urban areas, only 51% of non-limited access corridors currently have sidewalks on at least one side of the road. That’s right, there is a 49% sidewalk gap in urban areas, and we're only talking about one side of the road!

The “Statewide Bicycle Facilities Study” completed two years ago, found that 65% of state roads are without bikeways to State Highway System (SHS) facilities and are either in, or within, one mile of urban areas. That study went on to state that “ …planning for and implementing on-road bikeways in urban areas should be given the highest priority in terms of available funding….”  SAFE believes that after a wait of two years after the release of this study, it’s time for action. SAFE further believes that there will be no magically created new funds found to do this….so it must be accomplished by reallocating existing funds.

  1. Co-sponsor and support HB 11 & SB 94 enacting a primary safety seat belt law for all vehicle occupants.

SAFE’s Comment: There is a proven, direct correlation between the use of seat belts and the reduced risk of fatalities. Even though Florida has a high, state comparative seat belt usage rate, more lives can be saved by a more stringent law. Opponents in the past have argued that racial profiling will occur with such a law. SAFE believes that this issue needs to be addressed forth rightfully and openly. There is also a monetary reason for such a law. On August 30, 2007, the US Transportation Secretary announced that 17 states, DC, Puerto Rico, and four territories will receive a total of $109 million under a federal program to encourage and enforce seat belt use. CA received over $19 million, NY $11, and TX $14. Since FL does not have a primary seat belt law, it received $0.

  1. Co-sponsor and support HB 77 & SB 282 re the restriction of the number of certain passengers permitted in a vehicle operated by a person under a certain age

SAFE’s Comment: Studies have shown that teenage drivers (especially new drivers) are easily distracted when there is a carload of other teenagers in the car. As a result, there is a higher incidence of crashes.

  1. Encourage Florida municipalities to create Citizens’ Volunteer Ped/Bike/Greenway Committees. Also, encourage MPO District Offices to encourage every municipality within its district to send a representative to its monthly MPO Technical Advisory and Ped/Bike/Greenway Committee Meetings.

SAFE’s Comment: Perhaps, this request may be addressed without a state law. That depends on the will of the legislators to act by using their bully-pulpit.  Florida has a state Ped/Bike Coordinator, as do each MPO & FDOT Districts resulting in a coordinated effort between the state and the counties. Where the communication link falls apart, is in getting the message out at the local level. Until the municipalities are included in the communication loop, slow, little, or no progress will be made where it needs to be made. As far as SAFE is aware, only Boca Raton and Delray Beach have such representation at its district MPO level. SAFE assumes that is true at all the other district MPOs throughout the state. It is imperative that the local transportation communication loop be closed. Life’s are depending on it.

  1. Limit liability exposure for water management districts to facilitate the use of canal banks for greenways.

SAFE’s Comment: As SAFE understands, these districts have opposed greenways and trails primarily because of the unrestricted liability they would incur unless this liability is limited by state law. Attempts in the past have been made to restrict this liability by previous state legislators.  We need to try a little harder in the 2008 Session.

9.      Ask the FDOT to install “Obey 3’ Passing Law” road signs on roads & highways heavily travel by bicyclists (could be included on existing “Share the Road” signposts).

SAFE’s Comment: Unfortunately, the FDOT (at both the District and Central Office level), have resisted SAFE’s request for installing these road signs. SAFE believes that until there are road signs, many drivers will remain ignorant of this safety law. There are so many out of state, and out of country visitors, that the only effective way of letting them know about this rule of the road is by the use of road signs. At a minimum, SAFE steadfastly believes that these road signs must be installed on roads heavily traveled by bicyclists – e.g. SR A1A in Palm Beach County.

  1. Accelerate sidewalk accessibility for the handicapped by requiring municipalities to first use State/MPO enhancement funds for that purpose. Also, set a date certain for all Florida counties and the State of Florida to bring all existing county and state sidewalks up to ADA standards.

Safe’s Comment: Many years ago, the ADA required even small businesses to become American Disability Act (ADA) compliant (at a considerable cost). Unfortunately, the public sector did not face a similarly stringent requirement. It’s past time to raise the bar, and speed up the conversion of sidewalks on state ,county, and municipal roads.

Status of the SR A1A Lawsuit
 
The status is the same as reported in our last newsletter.
 
To recap: The "Bicyclists" and the FDOT are awaiting a ruling from the Appeals Court on their request for Oral Arguments. The next step will come from the Court. It will either grant, or deny, the Oral Argument requests. At the same time, the Court will announce when and where the case will be heard, and will identify the panel of three judges that will hear and decide the case.
 
My impression, in talking with the Clerk's Office, is that this announcement will be made sooner, rather than later.
 
SR A1A Construction Activity in Delray Beach
 
Several SAFE members who live in Delray Beach have told me how they marvel at how Ranger Construction is able to operate in the tight spaces that it does. The drainage work appears to be progressing smoothly with some expected back-ups when two-way traffic intermittently becomes one-way. Once the work is suspended on November 15th, SAFE will take a close look and contact the FDOT if there are any suspected trouble spots. At this point, those bike lanes are looking good and so is the drainage!
 
 
Letter to the Editor
 
Below's a "letter" from today's Palm Beach Post. Is there anyone who would want to respond to it, or do you want it to simply go unanswered? Has anyone seen the designated  bike lane on SR A1A he's referring to? Does anyone want to explain what a designated bicycle lane is? Do you think if the writer had to drive his car in a 6' travel lane instead of a 11' travel lane, he'd be happy about it?
 
 

Bike lanes good; if only cyclists would use them

It's a shame that the state spent millions of dollars, and disrupted traffic, to build a bike lane on A1A that is not being used. I supported the cyclists when they lobbied to build the lanes in Palm Beach County.

On Sunday, however, I was driving through Ocean Ridge and observed several groups of bicyclists riding in the roadway. Some rode three-wide in the traffic lane, not even attempting to conform to single file when cars approached. I encountered an elderly man with his middle-aged son, directing me to drive around them by waving their arms. Neither would move off the road onto the designated bike lane. I had to follow them for several minutes before I could get around them. As if this wasn't bad enough, both cyclists had words for me and my passenger. They told us that the bike lane was not wide enough and they weren't going to move over.

After seeing the cycling groups totally disregarding the bike lane and laws, I hope that local law-enforcement agencies and courts will now work together to make the non-law-abiding cyclists obey the laws. This will make the roads safer for everyone involved.

The first ride was held at a different bike shop last year. I got
called into work and only got to do a short / quick (6 AM) ride to the
17th St. bridge, back to Light House point bridge. The GOOD news, yes
the bike lanes (North / South) near Sea Ranch Lakes have been fixed
and are fine. The BAD news is right at A1A and Holiday Inn heading
North, they were doing street repairs there and ROCKS (Tons of
them...) were all over the road. :-(  Glad I was on the off-trail
Agio... ;-)

least go to the rails to trails web site or start calling your state
representatives.  They all need to know that cycling matters here in
florida.  With all of the proposed cutbacks looming we have to let
them all know now that bicycle funding can not be one of them.

On September 11, 2007, Florida U.S. Sen. Mel Martinez (R) voted to
eliminate all federal spending on trails and other walking and
biking facilities.

Tell Sen. Martinez that Florida needs more opportunities for walking
and biking, not less.

Sen. Martinez's vote was in support of an extreme amendment proposed
by Sen. Tom Coburn (R-Okla.) that blamed bicycle and pedestrian
funding for the August Minneapolis bridge collapse. This claim was
made despite the fact that, since 2006, states have returned more
than $2 billion in unspent bridge project funding to Congress.
Coburn's amendment was defeated 80-18.

This misguided scapegoating attempt cannot go unchallenged.

Please explain to Sen. Martinez why cutting trail, walking and
biking funds would be a huge blow to Florida.

Bicycle facilities and trails have strong transportation value,
produce zero emissions, support healthy lifestyles and provide
economic development opportunities. We need more, not less, funding
for bicycle facilities and trails. Federal funding has helped to
create numerous miles of highly used bike lanes and trails: the Fred
Marquis Pinellas Trail and Cady Way Trail; regional connectors such
as the Withlacoochee State Trail and the Suncoast Parkway Trail; and
the soon to be constructed 50-plus mile East Central Regional Rail
Trail and 49-mile Palatka to Lake Butler Rail Trail.

After you have taken action, please be sure to ask other Floridians
to act as well. By multiplying our voice, we can convince Sen.
Martinez to do the right thing in the future.

The patrolman said this warning should be listed, on the driver's seat sun-visor - NEVER USE THE CRUISE CONTROL WHEN THE PAVEMENT IS WET OR ICY, along with the airbag warning. I actually spoke to the fellow who owns the company, He says they over engineer the rack, it is very
sturdy, and it holds the bikes very well.  I'm getting one myself to carry 2 bents. You can have it custom
made to the size you want up to 72" The very unique component about the rack is the way they secure
the bike. The  rack is designed to transport your bikes with both wheels sitting  on the  rack and secured to the rack by the wheels and the crank,
The crank is the strongest part of the bike so this make sense. Your bikes do not dangle and band together and nothing touches your bike frame's paint.

Hey Bob,
I am not exactly sure if this was the same company but this rack looks
a lot like one that one of my customers with a Catrike 700 bought for
the roof of their car.  It has the same J-hook and three rails but
instead of being hitch mounted it was attached to the roof racks.
They told me it was what they thought they were looking for, but it
arrived in as a box of parts and they had to figure out how to put it
together.  After looking at it and helping to remove the trike I would
have to say it takes at least two people to get the Cat on and off of
the car but when its on it seams to be a solid mount and I don't think
it will be going anywhere.

Hi!

I'm new on the list... and I just bought my second Stratus in 10 years (I was out of recumbency that long). I just bought an Alpaca hitch rack, which I mounted on my wife's Honda CR-V and it worked out very, very well. All I had to do was flip the handlebar backwards, which I bungied and it worked great in getting the bike down from Atlantic Cycles down to Miami on the Turnpike.
