NASCAR driver Wimmer convicted of drunken driving
HIGH POINT, N.C. (AP) -- NASCAR driver Scott Allan Wimmer was sentenced to a year probation and 24 hours of community service after being convicted of drunken driving and fleeing the scene of an accident Tuesday.
Wimmer was given a 60-day suspended prison term, served only if he violates probation, and will lose his driver's license for one year. He has already undergone an alcohol assessment, satisfying the last term of the sentence.
Wimmer was arrested Jan. 31 for driving while impaired after wrecking a 2004 Dodge Ram pickup truck owned by Bill Davis Racing. Wimmer drives for the High Point-based racing team in NASCAR'S Nextel Cup series.
Chuck Alexander, Wimmer's Winston-Salem-based attorney, said he will appeal the decision of a District Court judge, meaning Wimmer can keep his license until the appeal is resolved.
Police had found some of Wimmer's possessions near the truck that had overturned in a ditch. Wimmer was found in his High Point home, crouched beside his bed and bleeding from a head wound, police said.
High Point police records state that Wimmer was charged after a breath test found he had a blood-alcohol level of 0.15, nearly twice the state legal limit of 0.08.
His wife, Judy Ambrose, was found innocent of charges that she impeded the investigation by lying to police.
Wimmer moved up to the Nextel Cup last fall after three seasons of racing in the Busch Series. He had five wins in three years in the Busch Series.

NASCAR officials are withholding comment on Nextel Cup rookie Scott Wimmer's conviction on drunken driving charges stemming from a Jan. 31 arrest in High Point, N.C.
Following a bench trial Tuesday in High Point, Wimmer, 28, was convicted of driving while impaired. He was given a 60-day suspended sentence, 24 hours of community service, fined $100 plus court costs and must relinquish his N.C. driver's license.
Wimmer is appealing the conviction, his attorney said in court.
NASCAR officials plan to wait to comment until they have had time to review the conviction and speak with Wimmer, spokesman Mike Zizzo said late Tuesday.
Wimmer was arrested in the early morning hours Jan. 31 after wrecking a 2004 Dodge Ram pickup truck owned by his Cup team, Bill Davis Racing.
Police apparently found Wimmer hiding behind a bed at his home in High Point, and his blood-alcohol content reportedly was nearly twice North Carolina's legal limit of 0.08 percent.
Wimmer's wife, Jody Ambrose, was charged with misdemeanor obstruction and delay in the incident. Ambrose, however, was found not guilty of that charge on Tuesday.
A valid driver's license is not a requirement to compete in NASCAR. Competitors must have a valid NASCAR license.
NASCAR says Dale Earnhardt Jr. will serve as "president" of Daytona International Speedway on Wednesday. His duties are scheduled to include the announcement of the purse for the July 3 Pepsi 400 Nextel Cup race as well as the selection of the paint scheme for the Pepsi 400 pace car.
NASCAR says Aug. 20 will be observed as the inaugural “NASCAR Day” nationwide to raise money for the Victory Junction Gang Camp. Businesses are being asked to allow employees to wear NASCAR apparel to work for a donation of $5 or more, with proceeds going to the NASCAR-themed North Carolina camp founded by Kyle and Pattie Petty for children with life-threatening illnesses. Marsh Racing says Todd Bodine has been hired to replace Dave Blaney as the driver of the team's No. 31 Ford in the Busch Series. Bodine is scheduled to take over for this weekend's MBNA America 200 at Dover International Speedway. The team, which plans to compete in 10 races this year, says the parting with Blaney was amicable as he pursues a full-time ride in the Nextel Cup Series. Bodine has 15 wins in 303 Busch Series starts.
Dover International Speedway says work has been completed on a new, 94-foot-tall scoring pylon that will be operational for this weekend's NASCAR races. The new scoring tower, which is located near the start/finish line, will show the top 15 cars and have two extra slots to scroll through the rest of the field. The tower also shows the speed of the race leader.
1990 Daytona 500 winner Derrike Cope has lost his NASCAR Nextel Cup ride with the No.50 Arnold Motorsports team and will be replaced by Mike Wallace for this weekend's MBNA 400 at Dover International Speedway.
Despite being 36th in the 2004 NASCAR Nextel Cup Standings, noted journeyman Cope has done a solid job through the first 12 events of the season and qualified an outstanding fifth for the Carolina Dodge Dealers 400 at Darlington.
However in 12 starts the No.50 Dodge has finished no higher than 25th (also at Darlington) and has nine finishes of 30th or worse and after a 34th place effort in last Sunday's Coca Cola 600, team owner Don Arnold gave Cope his marching orders.
“Certainly I'm not pleased,” Cope said this morning.
“This wasn't something I anticipated. There are no hard feelings. Some things happen for a reason.”
Wallace, whose last NASCAR Cup start came in last November's Checker Auto Parts 500 at the Phoenix International Raceway with James Finch's No.09 Phoenix Racing team, will run an undisclosed number of races in the No.50 with backing from his current Busch Series sponsors Geico.
Road course expert PJ Jones will also come on board for two of the three races that follow this weekend's event at ‘The Monster Mile' and will pilot the No.50 Dodge at Pocono and Sears Point.
No decision has been made as to the driver for the event at Michigan on June 20th.
Cope becomes the second official Arnold Motorsports driving casualty after the team released Billy Bigley Jr less than half a season after entering NASCAR's highest division in August 2003.
Biil Elliott has signed on to be part odf "Racing's Greatest Night of Champions" at Wall Township Speedway in New Jersey on Saturday evening June 12.
In addition to participating in a meet and greet session with the fans, Elliott will also strap himself behind the wheel of one of the track's Street Stock cars for a race with nine other of NASCAR'S greatest speedsters. Apparently that is not enough racing for Elliott, however, as he has also announced that he will battle local drivers in the night's 20-lap Truck Series main event.
Heading the list of champions on hand will be former NASCAR Champion and current FOX Network commentator Darrell Waltrip. Waltrip, a Daytona 500 winner who currently competes in a limited number of Craftsman Truck Series races, jumped at the chance to visit Wall Township Speedway after his brother Michael was forced to cancel his appearance. Michael Waltrip will not be able to attend since his race team has decided to chase the NASCAR Busch Grand National title.
Representing the current day stars will be Kevin Harvick, Sterling Marlin, Jimmy Spencer and Kerry Earnhardt. The list of NASCAR legends that will participate is just as impressive with Cale Yarborough, Harry Gant, Ernie Irvan, Dave Marcis and Dick Trickle announcing their involvement.
Spencer will also drive a Modified stock car during the regularly scheduled racing program.

"Papa Joe" Hendrick, the father of Hendrick Motorsports owner Rick Hendrick who planted the seed that has grown into one of NASCAR's most successful organizations, was presented The Order of the Long Leaf Pine by N.C. Gov. Mike Easley on Tuesday.
The award is the State of North Carolina's highest honor presented to an individual for dedication and extended length of service to his or her organization.
Gov. Easley made the presentation at Hendrick's headquarters near Lowe's Motor Speedway, in front of nearly 450 of the organization's employees, including Hendrick Nextel Cup driver Jimmie Johnson, who won Sunday's Coca-Cola 600.
"Mr. and Mrs. Hendrick you really have helped the weak grow strong and you've made the strong grow great," Easley said.
"Because of the work that you two started many, many years ago, you have improved the quality of life of thousands of North Carolinians and those beyond this state."
"Papa Joe" Hendrick Jr., 84, has been in and out of a Charlotte, N.C., hospital battling cancer in recent months. He and his wife, Mary, were on hand Tuesday to receive the honor.
Johnson and former Hendrick driver Ken Schrader made remarks during the presentation. Johnson lauded "Papa Joe" for his courage in the face of adversity.
"Pop, you make us all wake up every morning and work a little harder seeing how hard you've fought through everything," he said. "You give us all a lot of inspiration to wake up each morning, put a smile on our face and get to work."

Stewart's car had Kid Rock painted on the quarterpanel and "American Bad Ass" on the hood, but NASCAR officials made Stewart tape over the offending song title. However during the first pit stop Stewart ordered his crew to pull off the tape, which the crew did.(Winston Salem Journal) UPDATE: been told by folks with the team that Stewart's car started the race without the tape covering any part of the song title and that Stewart made no such orders.
A near-capacity, boisterous crowd of about 650 people jammed into a high school auditorium Monday night in the first public meeting about a NASCAR racetrack proposed to be built in north Marysville Washington.
Supporters and critics showed up in full regalia: residents wearing bright red NASCAR jackets and logo-filled caps mixed uneasily with the red paper anti-NASCAR flags and protest signs of other residents. Both sides at times interrupted speakers with loud applause or boos.
Local government leaders told the crowd that they plan to continue researching the track and to share findings with the public.
Marysville Mayor Dennis Kendall said the city will form a citizens group to continue fact-finding work on the impact of a track. The Marysville City Council last week unanimously approved spending $30,000 on a race-day traffic study.
North Marysville is one of several sites International Speedway Corp. is considering in its plans to build a NASCAR track in the Northwest. City and county officials prepared a proposal for a 75,000-seat track on 600 acres near the Arlington Airport.
Other potential sites include Monroe, near Olympia, in Kitsap County and near Portland, Ore.
While the Marysville proposal has many supporters, it also has organized opposition. Some have joined Snohomish County Citizens Against a Racetrack, or SCAR. Critics say a NASCAR track would be costly to taxpayers, would create traffic and noise problems, would harm the environment and wouldn't be the economic boon predicted.
Snohomish County's leaders disclosed the county's site recommendation in April, generating strong reactions from two groups.
People representing SCAR, waved red flags in opposition last night. Members of Fans United for NASCAR, meanwhile, wore "Back the track!" buttons.
Snohomish County Executive Aaron Reardon and county Executive Director Paul Roberts told the audience that a recently published economic-impact study and officials' visits to tracks elsewhere were only first steps in a lengthy research process.
Greg Wright, an Arlington resident, said he wanted to show leaders there's positive sentiment for a track.
As they were leaving the meeting, Marysville residents Richard and Wendy Lester said most of the details discussed were included in a flier they received in the mail, they said.
"They understandably don't have all the answers yet," Wendy Lester said. "It's too early in the game to make a decision pro or con."
Richard Lester said he's most concerned with whether a race track would negatively affect his property values. The couple has heard opinions on both sides of that question.
Tamma and Rusty Hicks of Marysville liked the idea that nonprofit groups would benefit from a race track and be able to use it for fund-raising events.
"I didn't realize some of the environmental issues that are going on," Rusty Hicks said. "I think Marysville's smart on trying to get it. If it's going to come in, everybody should get behind it and make some demands for what they want, like the schools. We're in the music business, so wed like to see music events held there."
Tamma Hicks lived in Phoenix, where NASCAR has another track, and worked for a drugstore chain.
"The stores near the track tripled their sales for the week (when there were races), she said.
Dustin Sorenson of Arlington said he thinks the track "is a done deal. I think we should do it. This meeting was basically to tell us that they're going to answer our questions later. I think they're going to go ahead and build it, but I'm happy about that. "
Others, such as SCAR member and Arlington resident Bob Heavey, remained skeptical.
"I'm a concerned taxpayer who doesn't want my pocket picked," he said.
