WENATCHEE, WASHINGTON — 09/16/2005
A 19-year-old Wenatchee man was sentenced to
eight months in jail Monday after he pleaded guilty
to luring a 13-year-old girl in Pioneer Park.

Alberto Alvarez Horta had been charged with first
-degree kidnapping in the July 16 incident involving
two girls.

But in a Monday hearing in Chelan County Superior Court,
Chelan County Deputy Prosecutor Roy Fore said there was
not enough proof to demonstrate the more serious charge.

One of the victims lives in California and could
not be reached by prosecutors, Fore added.

First-degree kidnapping carries a maximum sentence of
10 years in prison and a $20,000 fine. The maximum
sentence for luring is five years in prison and a $10,000 fine.

According to a report written by Wenatchee Police Officer
Brian Miller, Horta approached a 13-year-old girl and her
friend for sex while at the park on July 16 and began pulling
them toward a pickup truck when they said ‘no.’

The girls escaped after one of them bit Horta’s
forearm and he let go, the report states.

Horta also pleaded guilty Monday to possessing
methamphetamine and was sentenced to six months
in jail.

A police search of the pickup truck following his arrest
revealed a pipe containing the drug, Miller’s report states.

On Monday, Horta responded to questions from
Chelan County Superior Court Judge Lesley Allan.

“If I’m going to get six months, I’d like to be able to get out
(on work release) so I can pay (the court fines), because I
don’t have anyone to help me,” the orchard worker said
through a Spanish-language interpreter before being sentenced.

Fore had recommended that Horta receive six months in jail.

Allan referred to Horta’s crime as “very serious behavior”
and declined his request.
