Chelmsford, MA (AP) -- 12/03/2004
Effective Nov. 18 a law was enacted to address
the use of motorized (gas or electric) scooters.

"Motorized scooter" any two-wheeled tandem or three-wheeled
device, that has handlebars, designed to be stood or sat upon by
the operator, powered by an electric or gas powered motor that
is capable of propelling the device with or without human propulsion.

The definition of "motorized scooter" shall not include a motorcycle
or motorized bicycle or a three-wheeled motorized wheelchair."

The new law requires:
Motorized Scooter must comply
with Federal M/V safety standards

Operators must have a valid drivers license or learners permit

Scooter cannot exceed 20 MPH

Scooter operator must keep to the right side of the road at
all times (including when passing a motor vehicle which is
moving in the travel lane of the way)

Operators must adhere to all traffic laws and
regulations of the Commonwealth

Operators have the right to use all public ways in the
Commonwealth (except limited access or express state
highways where signs specifically prohibiting scooters
have been posted)

Scooters must be equipped with operational stop and turn signals

Scooters cannot operate upon any way at any time after sunset or
before sunrise

Operators must wear protective headgear conforming with
minimum standards of construction and performance as the
registrar may prescribe

Passengers are not allowed

Violations:
First Offense = $25 Fine
Second Offense = $50 Fine
Third or Subsequent Offense = $100 Fine

The new motorized scooter law is welcomed and needed.
Parents need to be informed about it as quickly as possible.
Chelmsford Officers will be conducting educational enforcement
over the next few weeks.
