2AM News: The week in review March 5-March 11
Second Amendment News Digest

A good week for self defense stories as armed homeowners (including a
75 year old grandmom) fend off intruders in Tennessee, Utah, Missouri,
Florida, Illinois, Texas, Arizona and Ohio, and store owners and
clerks protect their stores from robbers in California and Arizona.
Dummies of the week award to clueless raffle winners in South Carolina
who turn down the AK-47 prize (hey, I'm in SC, they could give it to
me!), and a court in Missouri hears a gun permit case for a guy denied
a permit because he was once evaluated at a mental health facility
(evaluated and with no finding of mental illness) ... and while not so
dumb Iraqis keep their Kalashnikovs handy and buy more weapons for
protection.

Keep up with the latest on the arrest of Angel Shamaya, founder of
KeepAndBearArms.com, jailed last week in Michigan on for possession of
firearms not properly registered under Michigan law ... Angel's court
date is March 14, and you can send messages of support or
contributions to his defense fund at the Montana Shooting Sports
Association "Angel" page at www.marbut.com/Angel/.

Til next week

RICHARD REMUS FOR COOK COUNTY SHERIFF

Richard continues to campaign hard and I hope to have a pretty good announcement to make soon. I have met with Richard twice since I emailed last. He is the real deal when it comes to guns and he is common sense when it comes to applying the law. He is no Barney Fife, however I suspect machine candidate Tom Dart may fit the Fife profile to a tee.

Last night Richard picked up the endorsement of the Polish Police Association. The support just keeps building.

Some of you have been asking about signs. The best way to get one is to come to the rally tomorrow night in Summit. Here are the details.

All Available Volunteers Get Out The Vote Rally

                                Location -        VFW Hall

                                                        7256 W. 63rd St. Summit, IL.

                                Date & Time - Thursday, March 9, 2006 - 7pm to 10pm

Food & Drinks - $10.00 Donation At The Door

I will be there and will get a few extra signs for pickup in Oak Brook, IL. Richard's signs are starting to sprout up so your help is greatly appreciated.

Finally I have sent a mailing to all the VFW's and American Legion to advise them of Richard's campaign. It would be a great help if you passed out word of this campaign to others. Going to be a small turnout and every vote is going to really count on Tuesday, March 21st.

Hope to see you in Summit tomorrow.

John

US bans sale of chemicals to hobbyists without $1K license

Amateur science tinkering -- another casualty of the war on terror? Boing
Boing reader Josh says,

Popular science and chemistry supplier United Nuclear (known by many
for their amazing neodymium magnets) is faced with legal action from the
United States CPSC. The CPSC proposes that all people attempting to
purchase a slew of common chemicals, some of which are in children's
chemistry sets, must have a current license to manufacture explosives
issued by the ATF. This would extend to people who do not and will not
have anything to do with explosives.

The list of controlled substances includes aluminum, titanium, zinc,
zirconium, and sulfur.

NEWS RELEASE

SAF SEEKS CONTEMPT VIOLATION AGAINST NEW ORLEANS MAYOR, POLICE CHIEF

BELLEVUE, WA – Frustrated by the continued failure of New Orleans Mayor Ray Nagin and Police Superintendent Warren Riley to comply with a federal injunction issued las t September to halt illegal gun confiscations following Hurricane Katrina and return all seized firearms to their owners, the Second Amendment Foundation and National Rifle Association have filed a motion in federal court to have both Nagin and Riley held in contempt.

SAF Founder Alan Gottlieb said the motion was made only after attorneys had exhausted all attempts to communicate and cooperate with the defendants, who have essentially ignored the federal court order. SAF and NRA took the city to federal court in September after widespread reports of gun confiscations in direct conflict with the Second Amendment and the Louisiana State Constitution.

“If Ray Nagin and Warren Riley think this lawsuit, and the court order, will just go away by pretending they don’t exist, they are sadly mistaken,” Gottlieb said. “Authorities in nearby Tammany Parish complied with the injunction immediately, and have agreed to the permanent restraining order. Counsel for New Orlean s signed a consent order last Sept. 23, so they know this case is on the table.

“The City of New Orleans has insisted that no guns were seized, and we know that’s not true,” Gottlieb continued. “Our attorneys have provided the New Orleans attorney with evidence of the confiscations, including witness statements, and that information has been ignored. Authorities in New Orleans have made no attempt to comply with the consent order and return the firearms seized by police.

“Mayor Nagin seems to be suffering from the same denial that possessed him before the hurricane hit, and in the days afterward when he blamed everyone else on the map for his failure of leadership,” Gottlieb observed. “We want Nagin and Chief Riley to appear in open court and testify under oath why they should not be held in contempt. They have been given every opportunity to comply with the court order and they have done nothing. They are not above the law.”

McCain Still Trying To Gag Gun Owners From Criticizing
His Anti-gun Record

Gun Owners of America E-Mail Alert
8001 Forbes Place, Suite 102, Springfield, VA 22151
Phone: 703-321-8585 / FAX: 703-321-8408
http://www.gunowners.org

Tuesday, February 28, 2006

A few weeks ago, we alerted you to legislation -- introduced by
anti-gun Senator John McCain (R-AZ) -- which is aimed at squelching
the First Amendment rights of grassroots groups like Gun Owners of
America.

That bill, S. 2128, is ostensibly aimed at dealing with some of the
congressional controversies that have hit the media in recent weeks.
A true reform bill would focus the spotlight on members like John
McCain, who was one of the original Keating Five senators who were
deeply implicated in the savings and loan scandal.

Instead, McCain began his war on real transparency in 2002 when he
teamed up with anti-gun Sen. Russ Feingold (D-WI) to push the
Incumbent Protection Act into law -- an act that stifles the ability
of organizations like GOA to criticize elected officials before an
election.

Now with the Gag Act (S. 2128), McCain wants to target his wrath on
groups like GOA -- requiring them to register their "grassroots"
communications and to file twice as many frivolous reports.

If McCain succeeds in pushing an expansive interpretation of his bill
(as he did when he convinced the courts to regulate the Internet
under McCain-Feingold), then we could see a host of draconian
restrictions affecting both GOA and you.

For example, if we wanted to alert you to gun ban that is moving in
our nation's capital, we could first have to tell McCain (and all his
other buddies in Congress) about what we're planning to do, who we're
planning to alert (that is, grassroots folks like yourself), how much
money we plan to spend, etc.

Because of Section 105 in this bill, everyone with whom GOA contracts
to get the word out (advertisers, printers, etc.) could be required
to tell Congress twenty days in advance about GOA's public
information campaign.

In effect, we would end up alerting Sarah Brady every time we plan to
wage a grassroots campaign in opposition to gun control.

This is ridiculous!

No doubt, the Gag Act is further proof that grassroots lobbying
works. It works so well, that John McCain wants to muzzle it.

S. 2128 -- or a bill that is similar to it -- is now likely to come
to the floor of the Senate in early March, according to Majority
Leader Bill Frist. It is imperative that we contact our Senators
today.

ACTION:

1. Please urge your Senators to oppose the Gag Act (S. 2128). And,
if your Senator has cosponsored the bill, then he or she especially
needs to hear from you. Senators who have cosponsored this bill are:

Conrad Burns (R-MT)
Norm Coleman (R-MN)
Jon Kyl (R-AZ)
Joseph Lieberman (D-CT)
Bill Nelson (D-FL)
Olympia Snowe (R-ME)

You can visit the Gun Owners Legislative Action Center at
http://www.gunowners.org/activism.htm to send your Senators a
pre-written e-mail message such as the one below.

2. Take action and then please forward this alert to your pro-gun
friends and family!

----- Pre-written letter -----

Dear Senator:

Now that the Senate is looking to pass so-called lobbying reform
legislation, I hope you will NOT support any bill that would gag
grassroots lobbying organizations.

To be sure, John McCain's bill (S. 2128) would do just that!

In 2002, Senators McCain and Feingold teamed up to pass the Incumbent
Protection Act, a bill that infringes upon the First Amendment rights
of gun owners and other Americans by squelching their ability to
criticize elected officials before an election.

Now, Senator McCain wants to pass the Gag Act (S. 2128). In this
latest version, McCain targets his wrath on grassroots organizations
-- requiring them to register their "grassroots"
communications with
their members and to file twice as many frivolous reports.

Please oppose S. 2128 or any other "reform" bill that would
scapegoat
outside groups, through which American citizens are better able to
petition their government and which serve as government watchdogs.

Sincerely,

This debut DVD from provocative filmmaker and talk-radio host Larry
Elder aims to mirror Moore's quest for a confrontation with General
Motors' CEO, Roger Smith -- except this time it's Moore himself who
is being pursued. "Michael & Me" follows Elder over an 18-month
period as he attempts to locate the elusive Moore in order to quiz
him about some of his assertions in his attack on guns and gun
owners in "Bowling for Columbine." Prominent in Elder's mind is the
question of how many Americans have managed to stay alive after
using a gun in self-defense.

The DVD includes interviews with prominent Second Amendment
spokesmen, including several appearances by GOA's executive
director, Larry Pratt. It's now ON SALE through Gun Owners

Justice Scalia: Guns Not Just for Crime

U.S. Supreme Court Justice Antonin Scalia fondly remembers carrying a
rifle around New York City as a boy and says outdoorsmen should attack the
idea that guns are only used for crimes.

An avid outdoorsmen who's hunted with Vice President Dick Cheney, Scalia
spoke Saturday at the National Wild Turkey Federation's annual convention.

"The attitude of people associating guns with nothing but crime, that is
what has to be changed," Scalia told the audience of about 2,000.

"I grew up at a time when people were not afraid of people with firearms,"
said Scalia, noting that as a youth in New York City he was part of a
rifle team at the military school he attended.

"I used to travel on the subway from Queens to Manhattan with a rifle," he
said. "Could you imagine doing that today in New York City?"

Scalia was criticized in 2004 for hunting ducks with Cheney while the
Supreme Court was considering a case involving Cheney's energy task force.
This month, a lawyer hunting with Cheney in Texas was wounded when he
stepped in the way as Cheney fired at a bird.

The nonprofit turkey federation is dedicated to conserving wild turkeys
and preserving hunting traditions.

    NEWS RELEASE

‘BRADYS ONCE AGAIN DANCING IN BLOOD,’ SAYS CITIZENS COMMITTEE

BELLEVUE, WA – When Jim and Sarah Brady, the figurehead leaders of the Brady Campaign to Preven t Gun Violence, tried to make political hay from a hunting accident involving Vice President Dick Cheney over the weekend, they once again demonstrated their propensity for dancing in blood to push their anti-gun agenda.

That was the assessment from the Citizens Committee for the Right to Keep and Bear Arms (CCRKBA) today. Jim Brady was quoted in a Sunday news release quipping, “Now I understand why Dick Cheney keeps asking me to go hunting with him.” Sarah Brady cheerily added, “I’ve thought Cheney was scary for a long time. Now I know I was right to be nervous.”

“Poor taste is poor taste, no matter who utters it,” said CCRKBA Executive Director Joe Waldron. “Only Jim Brady would be allowed by the mainstream press to make such a crude and crass comment and not be called down for it. I am appalled that the Bradys chose to make such sarcastic, self-serving remarks about a hunting accident.

“We understand that Harry Whittington was struck by several small p ellets in the face, neck and upper chest,” Waldron said. “Fortunately, the wounds are not serious, and we wish Mr. Whittington a full and speedy recovery.

“Vice President Cheney is a lifelong hunter,” Waldron continued, “and all reports suggest everyone in his party was wearing hunter orange, and acting in a safe manner. If this mishap demonstrates anything, it would be that accidents happen, even to experienced hunters.

“In truth,” he noted, “hunting is among the safest of all outdoor activities, and hunters suffer far fewer injuries than football and soccer players, and even cheerleaders. In Texas, where there are more than a million hunters, in 2004 there were only 29 hunting related accidents. Thanks to hunter education and firearm safety courses, hunting accidents have steadily declined over the past 50 years to their lowest point.

“It appears that Mr. Whittington had separated from his companions to find a downed bird and did not alert Cheney and oth ers to his presence,” Waldron said. “We can’t imagine how badly Cheney must feel about this accident. On the other hand, we no longer have to imagine just how low Jim and Sarah Brady can sink. They have raised dancing in blood to a fine art.”

The biggest problem is that there are too many lawyers who would like to sue gun manufactures.  Why do you think that there are so many gun manufactures outside the US? I am not talking about a boycott, I am talking about pushing organizations like the NRA to buy from gun friendly countries. I am not talking about not buying from other countries, but it seems to be quite hypocritical to get a NRA branded item from a country which does not support RKBA.
One could argue that the positive support of a US-based *and* RKBA-friendly

That is more along the lines of what I am suggesting. Pressure on the US based NRA to buy from RKBA-friendly countries or better yet US companies.

Cheney shoots 78-year old lawyer with shotgun, story held 24h

"Harry Whittington, 78, was 'alert and doing fine' after Cheney sprayed
Whittington with shotgun pellets on Saturday at the Armstrong Ranch in
south Texas, said property owner Katharine Armstrong. (...) The vice
president's office did not disclose the accident until nearly 24 hours
after it happened."

Reader Comment: 'Om' says,

The important questions raised by this hunting accident are:

     1) *Are* lawyers in season right now?
     2) Was the lawyer at least a 4-point?
     3) Was Cheney within his permit limit?
     4) Was the Cheney aide misquoted about the lawyer's hunting suit
having a target on the back, or that he'd bought it at Target
        a while back?
     5) Will Disney adapt this into a cartoon about a baby lawyer
having to adjust to living in the wild without his parent?
     6) Is this what you should expect if you don't contribute enough
to a political reelection fund in the future?

One more: Or is this the administration's new plan for tort reform,

I am not talking about a boycott, I am talking about pushing organizations
like the NRA to buy from gun friendly countries. I am not talking about not
buying from other countries, but it seems to be quite hypocritical to get a
NRA branded item from a country which does not support RKBA.

That is more along the lines of what I am suggesting. Pressure on the US based
NRA to buy from RKBA-friendly countries or better yet US companies.

Just curious, but does that mean you do not purchase a majority of
fire arm manufacturers out there since a large part of them are
either owned or produced by/in foreign nations?

Not trying to be offensive, its surprising how many of the "American"
companies, aren't...hell, in some ways Taurus and H&K are more
"American" than Springfield (for example).

Cheers!

I know that some people don't like the NRA and that is fine, everyone is
entitled to their opinions, so please don't reply based on that. Every group
or organization has good points and bad points.

What I wanted to share is an idea which I think would be nice to be pushed
with firearms organizations in this country, not just the NRA, but in this
case it is specific to the NRA.

I recently responded to an upgrade of my NRA membership. As part of the
upgrade, you could choose between two "gifts". I decided to select the knife
instead of the clock. I recently received the knife and was a bit
disappointed that it was not made in the USA, but that got me to thinking
that firearms organizations should only purchase products which are produced
in countries which support people's right to keep and bear arms. It seems to
me to be a bit hypocritical to support countries by purchasing their products
when it goes against your beliefs. I think it would be best to buy a US made
product, but I can accept purchasing from countries which support the RKBA
(although I am sure of which other countries support the RKBA).

I have sent a message to the NRA with this, but thought that I would also
share this idea with others so that if you want to, you can also share with
organizations that they should do this (if you agree).

McCain Moves To Punish The American People And Grassroots Groups For
Congress' New Round Of Controversy

Gun Owners of America E-Mail Alert
8001 Forbes Place, Suite 102, Springfield, VA 22151
Phone: 703-321-8585 / FAX: 703-321-8408
http://www.gunowners.org

Tuesday, February 7, 2006

Sen. John McCain is at it again.

The senior senator from Arizona has worked hard to earn an F-rating
from Gun Owners of America. Once a presidential contender, Sen.
McCain became the poster boy for the misnamed Americans for Gun
Safety (AGS) several years ago and has sponsored several anti-gun
bills and amendments.

With such a record lurking in his closet, do you think Sen. McCain
likes it when groups like Gun Owners of America point out his
anti-gun antics?

Of course not. So in 2002, Sen. McCain teamed up with anti-gun Sen.
Russ Feingold (D-WI) to squelch the First Amendment rights of gun
owners and other Americans. These two men successfully pushed the
Incumbent Protection Act into law -- an act that stifles the ability
of organizations like GOA to criticize elected officials before an
election.

This suits Sen. McCain just fine since he knows the media is going to
give him a free ride in his upcoming bid for president in 2008. One
can expect the mainstream media to ignore the big government
tendencies of candidates like McCain, which is why it's imperative
for watchdog organizations like Gun Owners of America to be able to
freely communicate with the American people.

Not content with the limitations in the Incumbent Protection Act,
Sen. McCain has struck again. In an effort to reap political
advantage from the current controversies in Congress, McCain has now
introduced S. 2128 -- the so-called Lobbying Transparency and
Accountability Act.

In this bill, McCain targets his wrath on groups like GOA --
requiring them to register their "grassroots" communications with
their members and to file twice as many frivolous reports.

Sen. McCain would rather shine the spotlight on us and YOU, rather
than shine the spotlight on himself -- remember, he was one of the
original Keating Five senators and was the ONLY Republican in the
Keating Five "team."

Sen. McCain might try to dismiss the actions he took on behalf of one
of his biggest contributors, Charles Keating, but as author Mark
Levin notes, "In John McCain's America, any politician who accepts a
large contribution or gift from a donor, and then takes steps
consistent with the donor's interests -- even though there is no
legal quid pro quo -- is corrupt. Well, then, by his own standard,
McCain is corrupt."

Once the Chief of Staff to the Attorney General in the Reagan
administration, Mark Levin is now a contributing editor for National
Review Online. He is also a talk show host and the head of the
prestigious Landmark Legal Foundation in Washington, DC. Levin has
never been accused of pulling punches, and his discussions over
McCain's role in the Keating Five are no exception.

"McCain was the only Republican implicated in the Keating Five
scandal," Levin points out, "yet today he lectures his party
and his
president about 'the corrupting influence' of money in politics. He
rails against the so-called 'wealthy special interests' and their
ability to buy access to elected officials, yet this is precisely
what the Keating Five scandal was all about. And, of course, under
McCain's current standard, a politician who takes a principled
position that may benefit a donor is corrupt, even if no law has been
violated.

"The John McCain of old should be thankful that his political fate
wasn't determined by John McCain the reformer," Levin concludes.

ACTION: Contact your senators and ask them to oppose S. 2128, John
McCain's bill to scapegoat grassroots groups for his own moral
shortcomings.

You can visit the Gun Owners Legislative Action Center at
http://www.gunowners.org/activism.htm to send your Senators a
pre-written e-mail message such as the one below.

----- Pre-written letter -----

Dear Senator:

It should come as no surprise that Keating 5 Member John McCain is
responding to recent inside-the-beltway controversies by attacking
the First Amendment rights of grassroots groups. His most recent
travesty masquerading as "reform" legislation is S. 2128.

A true reform bill would focus the spotlight on members like John
McCain. Instead, McCain targets his wrath on groups like GOA --
requiring them to register their "grassroots" communications with
their members and to file twice as many frivolous reports.

Perhaps congressional transgressors need to be punished for the
Abramoff scandal. Perhaps Abramoff needs to be punished for the
Abramoff scandal.

But don't try to scapegoat legitimate law-abiding grassroots groups
for the moral shortcomings of people like John McCain.

The First Amendment says that, "Congress shall make no law...
[abridging the right of the people] to petition the Government for a
redress of grievances." This is a wonderful freedom that has been
enshrined in our Constitution for more than 200 years. I hope you
won't place even more restrictions on this precious right.

Please oppose S. 2128 or any other "reform" bill that would
scapegoat
outside groups, through which American citizens are better able to
petition their government and which serve as government watchdogs.

Sincerely,

what's that olde saying ...
unarmed citizens are _______________________

Going postal in gun-free zones

By Donald R. May

Feb 6, 2006

Evildoers like the Goleta killer flaunt their destruction on the world stage. The deranged former postal worker killed six unarmed defenseless Goleta, California postal workers and a former neighbor before turning the gun on herself.  As with Muslim terrorists seeking attention for their causes, suicidal murderers rivet our attention to their unhinged mental state and to the hatred they spew.

It should be no surprise that evil strikes in areas of least resistance. People intent on committing mass murder seek a high level of certainty that they will not face immediate armed confrontation. Though the details are still limited, the Goleta killer probably realized she would not encounter anyone able to resist her with a gun. Suicidal murders may be deranged, but they are not dim-witted.

Persons who are determined to kill large numbers have often targeted United States Post Office facilities. Other popular murder spree sites have been schools and churches. What these places have in common is that all ban law-abiding citizens from legally carrying personal defense weapons, access for criminals with weapons is relatively easy and unchallenged, and armed security is limited or absent. Mass murders are more likely to occur in designated gun free zones and not where others are armed. Large numbers of people are not shot in gun stores and at shooting ranges.

Past news media blitzes following Post Office and school shootings augmented the numbers of laws restricting everyone’s rights. Rather than increasing safety, such laws further endangered workers, students, worshippers, customers, and all who frequent gun free zones. With fewer legal guns present, they become soft targets inviting the deranged. How many of us would post signs on our own homes announcing that we allow no guns on the premises?

Society needs to disregard the baseless calls for more restrictions on honest gun merchants and citizens. Their guns are not a significant source of criminal weapons.

Some will always have gun phobias, and this is unfortunate. Education helps. A personal encounter with an armed assailant helps even more.

Following Hurricane Katrina, many law-abiding citizens were disarmed and deprived of their right to protect themselves. As a result, the New Hampshire legislature has moved to protect the rights of its citizens from gun seizure during emergencies.

In countries where citizens have been disarmed and prevented from defending themselves, violence has escalated. Increased death and destruction have come from the ruling elite and from criminals. Within the first year of disarming the Australian public, firearm homicide increased by 300% in the state of Victoria, Australia.  Canada’s overall crime rate is now 50% higher than that of the United States. Violent crime rates, including sexual assault, are double that of the United States.

Throughout history, those who were inadequately armed were subject to the whims and cruelties of those who were. Those under Roman rule carried swords and other weapons for protection against thieves. The sword Simon Peter carried and used defensively was a personal protection weapon of those times

The heavy yoke of tyranny historically has kept most commoners disarmed. When the rebellious colonists starting rattling King George’s chain, his Redcoats moved to quickly confiscate their guns. With remembrance that it was the weapons they bore that secured their independence, our Founding Fathers penned the Second Amendment to insure our safety against the tyranny of the elite and the violence of our peers.

In some public areas, it is necessary to keep weapons out of the hands of everyone other than highly vetted persons employed to maintain security. Airports, certain government facilities, and airliners are places where it is not possible to quickly and efficiently screen the good guys with guns from the bad guys. Security keeps out unauthorized weapons, and armed personnel are there for protection.

Post Offices, schools, churches, and numerous other public and private places ban law-abiding citizens from carrying firearms but provide little or no security to prevent the deranged from bringing in weapons. Evil people intent on committing capital offenses are not deterred by laws and are emboldened with the knowledge their mayhem will likely go unchallenged for many minutes. The research of John Lott and William Landes has shown “that the only policy factor to influence multiple victim public shootings is the passage of concealed handgun laws.”

Some Post Office and school employees should be armed and permitted to carry concealed weapons. Federal and state policies should reflect the determined intent to kill armed perpetrators at the first opportunity. When armed terrorists and armed criminals are taken alive, sentencing and removal from public view should be swift to prevent copycats.

An armed citizenry is the best deterrence to violence. Public places where law-abiding citizens are not permitted to bear arms should be rare and few. Wherever legal guns are banned, screening and armed security should be present to prevent the entry of illegal weapons and to protect from terrorist and criminal violence.

The measure of a civilized nation is how effectively it is able to maintain its social order. This is a result of just and moral people who are able to regulate their own affairs and to protect themselves at times when their police and military cannot.

“To ban guns because criminals use them is to tell the innocent and law-abiding that their rights and liberties depend not on their own conduct, but on the conduct of the guilty and the lawless.” Jeff Snyder

THIS WEEK'S NEWS

(1) MI: Not just guns -- thugs with guns
Source: Saginaw News

"Police Chief Gerald H. Cliff advised Saginaw City Council members
Monday against buying citizen's guns to thwart violence, saying
buybacks didn't get the types of high-powered weapons used by gangs
off the streets.Cliff's straightforward evaluation of gun buy-backs
was right on target. Gun buy-back initiatives, in which officials
purchase guns from citizens, ostensibly to keep them out of the hands
of criminals, aren't effective. A handful of studies since the 1990s,
when the federal government gave cities cash to buy guns, show they
tend to lure law-abiding citizens to bring in small caliber guns. More
importantly, Cliff said the studies indicate buying "closet guns"
doesn't have a measurable impact on reducing violence. "

(2) KS: Gun advocates press for permit bill
Source: Wichita Eagle

" Kansas is one of only four states that offers no concealed-weapons
permits. Advocates of concealed weapons say they hope election-year
politics may change that. As they have for years, pro-gun lawmakers
are pushing a bill that would set up a permit process for residents
who want to carry a concealed firearm. Similar measures have passed
both the House of Representatives and the Senate in recent years, but
have always met with a gubernatorial veto. The bill by Sen. Phil
Journey, R-Haysville, would allow concealed weapons permits for state
residents over age 21 who pass a background check, complete a training
course, and have never been convicted of a felony. Residents with a
criminal background of domestic violence, two drunken driving
convictions or other certain offenses would be barred from the permit
process. Concealed weapons would be prohibited in certain areas, such
as state government offices, schools, colleges, day cares, bars,
sporting events, and any business that posts a sign banning them."

(4) NY: Mount Vernon man not guilty in slaying of ex-con
Source: Journal News

"A Mount Vernon man was acquitted of murder yesterday in the slaying
of an ex-convict who had shot him seven years earlier, after the jury
accepted his claim that he fired at the unarmed man in self-defense.
Mark Powell, 40, bowed his head, then thanked and hugged his lawyer
after the jury forewoman announced the not-guilty verdicts to charges
of murder and manslaughter. Powell was found guilty of a felony weapon
charge because the gun he used was not licensed. He faces up to seven
years in prison for the gun conviction. Westchester County Judge Rory
Bellantoni scheduled sentencing for March 22 in White Plains. Powell
shot Curtis Liburd on Sept. 17, 2005, on East Fourth Street in Mount
Vernon. He testified that someone told him Liburd had a gun and that
he grabbed his own gun from his car to protect himself when Liburd
confronted him and threatened him. He said he fired as Liburd came
after him and tried to grab the gun." (02/01/06)

(6) TX: Suspect killed in holdup
Source: Dallas Morning News

"A gunman who police say robbed a convenience store four times times
since July attempted a fifth robbery late Wednesday. This time, the
robbery ended with the gunman's death during an exchange of gunfire
with the store's owner, police said. The robber, whose name has not
been released, was found dead behind the H.E.B. Food Mart in the 1600
block of Sotogrande Blvd. He collapsed after being shot in the chest
by the store's owner, said Assistant Police Chief Richard Winstanley.
The owner was not wounded but a store clerk was shot in the lower back
and right arm. ... Police believe the same man was armed on July 12
when he entered the store and stole money along with the owner's gun.
The gunman, police said, returned Dec. 22, Jan. 5 and again on Jan. 9
using the owner's weapon in all of those robberies. Police set up
surveillance at the store and for three weeks there were no holdups,
he said. Around 11 p.m. Wednesday, the armed robber returned as the
store was about to close." (02/02/06)

(8) OH: Girls-and-guns posters rile town
Source: Cleveland Plain Dealer

"Puffy polar bears decorate the front of the Artful Dragon. Stacks of
canvas bags create a cozy bunker at Coffee Corner Antiques. The whole
block blends into a Norman Rockwell scene. With one exception. The
windows of the Gunrunner, decorated with two large posters of scantily
clad women toting firearms, stand out in this buttoned-down town.
Village officials call the gun shop's display inappropriate -- 'It's
pretty risque,' Mayor Nick Fischbach said -- and want it taken down.
Last week, Zoning Inspector Joe Hernandez deemed the Gunrunner in
violation of zoning regulations that limit the amount of window space
devoted to advertising to 50 percent. The warning does not address the
content of the display. Hernandez, however, admitted that the window
coverage issue is driven by, well, another coverage issue. " (02/01/06)

had not, as it declared last year, decommissioned its entire arsenal,

the General Assembly. House Bill 1572 didn't get through the House
Committee on Militia, Police and Public Safety. It died Monday in the

League. Gilbert was unavailable Monday and spokesman Gary Frink would
not comment on the bill's defeat other than to say the issue was dead

votes gave Governor Jim Doyle and other people against hidden weapons
a veto victory. The State Senate decided to override the veto and put
the decision into the hands of the State Assembly. It needed 66 votes

venues would not be allowed to protect its thousands of visitors from
the danger of hidden weapons. 'When people come to our city to enjoy
Summerfest, the State Fair, or other outdoor events they want to do so
in a fun and safe environment,' said Mayor Barrett. 'Concealed carry
is an irresponsible and costly bill that will force these venues to
create a dangerous situation for the million or so people who attend
the festival each year, and for the larger public.'" [editor's note:

(15) CA: Prosecutor: Shooting was self-defense
Source: Inside Bay Area

"An ex-convict will not be charged with murder for a Jan. 18 killing
police believe sparked a retaliatory attack last week that left two
people dead and three wounded, authorities said Monday. Police said
prosecutors have determined Derrick 'Dirty D' Knockum, 39, acted in
self-defense when he fatally shot Purnell Brewer, 26, of Berkeley in
the 2000 block of East 26th Street. Knockum was charged with being a
convicted felon in possession of a gun and violating parole. On Monday,
witnesses to the shooting confirmed that both Knockum and Brewer, who
were longtime friends, had guns, homicide Sgt. Ersie Joyner III said.
Joyner said Knockum 'had a legitimate fear he might be shot' and
defended himself. " [editor's note: So, let's punish him anyway for
managing to defend himself successfully - MLS] (01/31/06)

(16) Texas: Elderly homeowner shoots drunk intruder
Source: Galveston Daily News

"A 26-year-old Texas City man was shot and killed late Friday night
after he apparently mistook someone else's home for his own. Texas
City police Sgt. Brian Goetchius said David Wayne Stewart was shot
after he kicked in the door of a home in the 900 block of 26th Street
North around 11:30 p.m. Friday. Police said they believe Stewart, who
was walking home after picking up some food at a nearby fast food
restaurant, was intoxicated and was trying to get into the wrong
house. Stewart's own home is just blocks away, police said. Texas City
police received a call from a woman saying her husband had just shot
someone trying to break into their home. When police arrived, they
found Stewart lying inside the front doorway. Goetchius said the
74-year-old homeowner fired a single shot from a handgun. While an
investigation is ongoing, it is unlikely the homeowner will face any
criminal charges." (01/29/06)

(17) Canada: Police chiefs fear end to firearms controls
Source: Toronto Star

"The head of Canada's police chiefs says he will impress upon the new
federal government the merits of the national gun registry, a
much-maligned system the Conservatives have promised to scrap. Jack
Ewatski, president of the Canadian Association of Chiefs of Police,
said he wants to open a dialogue on firearms with the ministers to be
named early next month to the justice and public safety portfolios.
... The federal requirement to register shotguns and hunting rifles,
initiated by the Liberals in 1995, has long rankled critics who say it
is a wasteful exercise that does not reduce firearms-related crime. A
2002 report by the federal auditor general put the computerized
registry's price-tag at $1 billion, a figure that dwarfed the original
$2-million estimate and further riled opponents." (01/30/06)

(18) WY: State a battleground in "deadly force" debate
Source: My Way News

"In the 'Cowboy State,' where guns are present in more than half of
all homes, an unlikely battleground is forming in the fight over the
appropriate use of firearms. Flush with victory in its push for state
laws allowing concealed handguns, the National Rifle Association is
lobbying lawmakers here and in 11 other states to make it easier for
people to defend themselves with deadly force. The NRA, backed by a
growing membership of about 4 million, wants legislation specifying
that people have no duty to retreat from an attacker before using
deadly force. About half of all states have similar rules on the
books. But in Wyoming, the Brady Campaign to Prevent Gun Violence is
taking a stand. James Brady, the former press secretary to President
Reagan who was wounded in an attack on the president, called on
Wyoming legislators in a statement last week to oppose the
legislation, called it 'a sham, a farce, a dangerous solution to a
nonexistent problem.' ... Twenty-five states have such laws on the
books, and the NRA says 38 states now have some provision allowing
people to carry concealed handguns, up from just 10 in the mid-1980s."

THIS WEEK'S COMMENTARY

(19) Research on guns and road rage
Source: John Lott Website
Author: John Lott Jr.

"There are multiple concerns with this analysis. There is not attempt
to differentiate whether the person who had the gun in the car had it
legally or not. No attempt to determine whether they had a gun when
the rage occurred. While one regression with a few very basic
variables was apparently run (but not shown), no explanation was
offered for why such a limited set of control variables were used
(e.g., why not trouble with law enforcement, education, income,
smoker, race). Trouble with law enforcement (past arrests) would have
been obvious (though it would have been even better if they had asked
whether the person had convictions for felonies (I wonder why they
didn't include that question) .... After a second telephone call,
Hemenway said that while he will not give out the data used in the
paper, he may reconsider providing a portion of the data, but that he
can't make a decision before talking to his co-authors. He is also
very busy and would not say when he would check into even this."

(20) Gun owners take a stand
Source: Liberty Belles
Author: Jennifer Freeman

"The decision of whether or not to own a firearm and whether or not to
carry concealed is a personal one. Those who obtain CCW licenses and
who feel comfortable carrying in public places are taking a stand
against violent crime. People who carry concealed put themselves in
the unique position of being able to defend themselves and others if
faced with a potentially life-threatening violent criminal action. The
decision to use force if necessary to save lives is one of conscious
responsibility and forthright courage. It means standing up for what
is right rather than forfeiting all power to the criminal. It also
means standing up when everyone around you acquiesces." (02/02/06)

(21) Frisco may rue gun ban
Source: Tribune Democrat
Author: staff

"Voters in San Francisco have decided to ban public possession of
firearms in their city, a decision that may come back to haunt them.
Despite what anti-gun advocates proclaim, murder and violent crime
tend to rise in localities or countries that deny honest citizens the
right to bear arms, a right granted to Americans by the Second
Amendment to the U.S. Constitution. The San Francisco decision defies
that right. We look at cities such as Washington, D.C., New York and
Camden, N.J., where strict gun laws have proven that when guns are
banned, only criminals have guns -- and they use them. All three have
high rates of homicide, as well as other criminal violence." (01/31/06)

(22) Canada: Say goodbye to gun registry
Source: Brandon Sun
Author: staff

"The new Conservative government has the federal long gun registry in
its crosshairs, which has prompted some defenders of the program to
plead with the Tories not to pull the trigger on the much-maligned
registry. But the cries of clemency coming from crime victims and now
police chiefs, as compelling as they may be, must not be heeded and
the registry must be put out of its misery. ... The fact is that gun
crimes haven't been eliminated by the registry -- if anything, they've
gotten worse since the Montreal massacre of 1989. The gun registry
didn't protect four Alberta RCMP officers shot while raiding a farm in
northern Alberta last year. It didn't do anything to protect the
people in downtown Toronto hit by stray bullets during a Boxing Day
shootout. It didn't prevent innocent people in Winnipeg, Toronto and
other large Canadian cities from being killed by gunmen. All it has
done in the 11 years since its inception is cost the Canadian taxpayer
hundreds of millions of dollars and infuriate law-abiding citizens who
know that guns don't kill people, people kill people." (02/01/06)

(23) The America that might have been
Source: Mens News Daily
Author: Will Malven

"The scene, Massachusetts, April 18, 1775: Boston Globe -- Governor
General Thomas Gage has decided to move in and seize a cache of
registered firearms gathered by a few members of the NRA, a radical
organisation which believes that the citizens should have an
unfettered right to keep and bear arms, to fight against the
'Intolerable Acts.' These radicals are suspected of possessing highly
dangerous and illegal 'assault rifles.' ... The 75 rebels, led by
Captain John Parker, were quickly defeated as their hunting rifles and
pistols were no match for the Royal Troops and the automatic assault
rifles carrying 30 rounds each. Throughout the state ... the rebel NRA
members were quickly rounded up and imprisoned." (01/30/06)

(24) AK vs AR, the REAL data speaks
Source: Head's Bunker
Author: "Head"

"There's been the ever present, unending debate over which is best,
ARs or AKs. This debate rages on across the internet and in gun shops
every day sending bile and bitter insults spewing both ways. Thise
debate has turned fathers against sons, best friends against one
another, and, well you get the point. Your host is of the opinion that
there are of course pros and cons of each family of rifle, and I
refuse to engage in what is 'best.' As one who loves them all,
especially the AK and AR series, I thought I'd pass on some of the
knowledge I have gained over the years concerning these wildly
different weapons. As a bonus, I'll toss in my knowledge of the third
favorite family of weapons at the Bunker, just because they are very
popular these days and I often ramble about them. So, here, for the
aid of those hammering one another with debate, some unbiased,
non-slanted, untainted raw knowledge about the Ak, the AR and the
Mosin Nagant." (01/26/06)

(25) New laws, less sense
Source: Telegraph [UK]
Author: staff

"Do you feel safer as a result of the 30,000 pages of new law passed
each year by this Government? Or freer? Or clearer about your rights
as a citizen? Has your life in any way been ameliorated by the
avalanche of legislation unleashed since 1997? No? Then what in
Heaven's name was the point of it all? The answer, sadly, is that
statutes are no longer passed to remedy specific grievances. ... So
with the pistols ban or the police reforms that followed the
Macpherson report or the Draconian crackdown that followed 9/11. In
each case, ministers awarded themselves new powers rather than using
the ones they already have at their disposal. The result is a society
with more laws but less justice." (01/30/06)

(26) The time is approaching
Source: The Libertarian Enterprise
Author: Kathryn Graham

"Up until now, I have always been careful about what I have said in
any public forum. I have remained scrupulously within the laws on such
things as sedition, and confined myself to discussing legal methods of
redressing our many grievances against our government. With deep
regret, I am forced to tell you today that I no longer believe that
legal and non-violent methods of achieving change will be possible. "

(27) Vaccinations, gun bans top the mailbag
Source: Las Vegas Review-Journal
Author: Vin Suprynowicz

"One Craig Vincent writes in 'Hi from New Zealand, In New Zealand we
have to have a 10-year renewable firearms license that is required for
everything except air rifles and air pistols. ... A 'B' category
license covers pistols which you must use on a approved range at least
12 times per year (no shooting off range and no hunting) and they are
registered with about a 20 percent error rate in rego details.' An 'E'
category license 'is for 'military style' assaults rifles,' Mr.
Vincent reports. 'Semi-auto only and all are registered. If you have
an E-cat ALL your firearms are registered. Here comes the confiscation
:-( Even if the police won't admit it. Of course when you apply for
your license you must sign a declaration that you will never use a
firearm in defense of self or property. Richard Hilliard, mentioned in
your earlier article ('Familiar anti-capitalist sound bytes,'
Review-Journal Nov. 6,) obviously lives in a fairyland where pigs can
and do fly to say that firearms could never be banned in the USA.'"
