Police, Camera Coudn't save British Woman from No-Gun Crime

The camera caught Marsha, but couldn't save her
 
POLICE trying to piece together the last moments of Marsha McDonnell’s life believe that she may have been bludgeoned to death with a hammer by a would-be robber or sex attacker as she returned home from a night at the cinema.

Miss McDonnell, a 19-year-old gap-year student, was found on the pavement less than 100 metres from her London home early on Tuesday. She had suffered three blows to the back of the head from a heavy blunt instrument.

She was filmed by CCTV getting on the 111 bus outside John Lewis in Kingston upon Thames at 11.50pm on Monday for the ride to Hampton, West London, and again at 17 minutes past midnight getting off the bus alone, five minutes’ walk from home.

The killer is thought to have waited for her at a corner and pounced as she passed. Police believe that the assailant had intended to rob or sexually assault her, but was disturbed when a resident turned on his lights. The neighbour had heard a “thudding” noise outside and went to investigate. He found Miss McDonnell unconscious and bleeding, but her clothes had not been disturbed and she still had her purse and mobile phone.

Scotland Yard is now investigating possible links to hammer attacks in southwest London in the past six months: in August a man was attacked with a hammer in Richmond and had his wallet stolen, and there was a similar attack in Hounslow at Christmas.

Detective Chief Superintendent Dave Cook said: “It wasn’t a frenzied attack, there were quite deliberate blows to the head.”

ROBBERY RISING IN ENGLAND

Against a backdrop of overall reductions in recorded crimes in recent years
in England and Wales, increases in robberies this past year stand out as a
disturbing counter trend. And although robberies against persons, and
street crime generally constitute a very small proportion of overall crime,
their numbers are increasing.

A survey by the British Home Office examined over 2,000 crime reports and
witness statements across seven police force areas. The report focuses
specifically on personal robbery, which accounts for the bulk of recorded
robbery and almost all of the increase in recent years. Some of the
report's findings include:

    o   Robberies reported to the police in England rose by 28
        percent last year.

    o   There were 362,000 robberies in England last year, having
        more than doubled in a decade.

    o   Robbery in England is concentrated in urban areas -- 44
        percent occurring in London and another 25 percent in the
        West midlands, Manchester and West Yorkshire.

The report says 94 percent of suspects and 76 percent of victims are males;
seven in 10 offenders are under 20; and one in four victims is under 20 --
compared to one in 8 in 1993.

Comparing robbery statistics in England to France, the report shows:

    o   France has a slightly higher rate of robbery than England
        and has a similar rising trend -- the rate is lower and
        more stable in Germany, Canada and Australia.

    o   France and England now have higher robbery rates than the
        United States, where rates have fallen by over a quarter
        in five years.

The article (below) about  the LP Jim Lesczynski's "Guns For Tots" experiment in NYC says:
"Many criminals use toy guns because they know that if they are caught the penalty is less severe."

How do criminals figure that, except in a place like New York City where
law-abiding victims are expected to be completely disarmed (no real guns,
and no fake-guns)?  If potential victims on the streets of New York City
were "possibly armed", then the "penalty" perceived by criminals for
displaying even a toy gun to commit an apparently-armed Robbery would be
exactly the same as for brandishing a real gun during the same
Robbery-attempt:  the DEATH of the Robber.  That is proved in the cited case
of the armed under-cover cop who was being robbed at gun-point by a serial
Robber pointing a "toy" pistol (air gun) at him.  The cited Death of the
young serial Robber was not a good reason to take toy-guns away from
children, but is a good reason to place real-guns into the hands of
law-abiding citizens.  The political choice is simple:  Security of the
Law-Abiding, or an increasing population of Live Serial Robbers in New York
City.  Last that I heard, Young Robbers in New York City knew how to Rob
people riding Subway Cars by displaying screwdrivers and other homemade
"shivs" (a la Bernard Goetz).  Shall the New York City council next ban the
sale of toy-screwdrivers?

Note:  In New York State generally, the Law says that merely brandishing a
gun or what looks like a gun when necessary for self-defense is lawful
because it is Not an actual "Use" of "Deadly Physical Force" capable of
causing Death or other serious injury, (See, "Rights of NY" at
http://billst.clair.com/ferran ) and therefore, law-abiding citizens
(upstate) have the legal right to carry and to menacingly display
real-looking fake-pistols when necessary for their self-defense including
defense of their property.

"Reckless endangerment frequently involves the use of firearms, but no case
has been found which holds that the mere threatened use of a gun is
sufficient to support a reckless endangerment conviction and there are
decisions holding that it does not (see, e.g., People v Richardson, 97 AD2d
693, 694). The cases generally require that the weapon be fired, or at a
minimum, capable of firing .." People v. Davis, 72 N.Y.2d 32; 530 N.Y.S.2d
529 (1988).

A New Yorker being Robbed on the street by a punk brandishing a base-ball
bat or a fake-gun, or a screwdriver may lawfully use any degree of physical
force (e.g., Pepper-Spray, or a Threat Of Force, or actually shooting)
necessary to defend himself and his property.  In NY state there is never a
legal "duty to retreat" from a Robber PL s 35.15;  35.30(4), and there is no
Duty to Retreat generally from an assailant unless non-deadly force will be
insufficient to protect you and deadly force will be necessary.  "There is
no duty to retreat before using [non-deadly] physical force" for any of the
defensive purposes prescribed in PL 35.10(6), including a defense of one's
person from an unlawful assault.  In the Matter of Y.K., 87 NY2d 430, 434

Pepper-Spray *might* project a person from an assailant at a safe distance.
Fortunately, there are human inventions called "guns" which, because they
can "project force" at a distance, are capable of harmlessly stopping
assailants and robbers (by means of intimidating and discouraging) even
before they can reach and potentially do harm to law-abiding citizen.  As
Jefferson said: "an [apparently] unarmed man may be attacked with greater
confidence than an [apparently] armed man."

If they Outlaw Guns, only Outlaws will Have Guns.  Similarly, if they Outlaw
Fake-Guns, only Outlaws will have Fake-Guns.
